Hilateeca operates an online marketplace where users can create and sell their own custom-designed T-shirts and other merchandise.
We strictly forbid the listing or sale of any products that infringe upon the intellectual property rights of others, including but not limited to copyrights, trademarks, or any other legal protections.
If you believe that any user on Hilateeca has violated your intellectual property rights, please follow the reporting process outlined below.
A. Reporting Intellectual Property Infringement:
(1) Hilateeca will take prompt and appropriate action, which may include removing or disabling access to any content (“Content”), upon receiving a valid notification of potential intellectual property infringement.
(2) Repeated or severe violations may result in permanent account suspension. If you believe that any content on the Hilateeca platform infringes on your rights, please submit a formal infringement notice including the following details to our designated DMCA agent:
- A detailed description of the copyrighted or protected work, including any registration or identification numbers (if applicable).
- Identification of the allegedly infringing content, including:
- (a) An explanation of how the content infringes upon your rights.
- (b) The exact location (URL) of the infringing content on Hilateeca, with enough detail to help us locate it.
- Your complete contact information — including your name, mailing address, telephone number, and email address.
- A statement, made under penalty of perjury, affirming that the disputed use of your work or property is unauthorized by you, your agent, or the law.
- A declaration confirming that all information in your notice is accurate and that you are the rights holder or legally authorized to act on behalf of the owner.
- Your physical or electronic signature.
B. Actions Taken Upon Receipt of an Infringement Notice:
- Hilateeca will remove or disable access to the reported content immediately.
- The user responsible for uploading or listing the content will be notified about the action taken.
- Accounts found repeatedly violating intellectual property laws will be subject to suspension or permanent termination.
C. Filing a Counter-Notice:
If you believe that your content was mistakenly removed or that you have the right to use the material in question, you may file a counter-notice containing the following information:
- A clear description of the content that was removed and its previous location on Hilateeca.
- A statement, made under penalty of perjury, asserting that you have a good faith belief that the content was removed due to an error or misidentification.
- Your full contact details, including your name, mailing address, phone number, and email.
- A declaration consenting to the jurisdiction of the Federal Court in your area, or if you are located outside the United States, the jurisdiction where Hilateeca operates.
- Your physical or electronic signature.
If a valid counter-notice is received, Hilateeca may forward it to the original complainant. Unless the complainant initiates legal action, the removed content may be restored within 10–14 business days.
Please note: Under Section 512(f) of the DMCA, any individual who knowingly submits a false infringement claim may be held responsible for damages, including legal fees and associated costs.
